Buying a home with your partner is a big step, and in Spain same-sex couples have exactly the same rights as anyone else. The key is understanding how ownership is split and what to protect in writing.
Ownership and shares
When you buy together, both of you appear on the title deed as co-owners. You can split the property 50/50 or by the share each of you contributes (for example 70/30). It’s worth stating this clearly in the deed to avoid doubts later.
Joint mortgages
Most banks offer joint mortgages to same-sex couples without distinction. You are both liable for the loan, and your incomes combine to qualify. Compare offers and ask for the conditions in writing.
Marriage, inheritance and family
Spain has recognised same-sex marriage since 2005, with full effect on inheritance, pensions and adoption. If you aren’t married, a registered civil partnership or a will protects the survivor, since the law won’t treat you as equivalent automatically.
